What Is a Trust?

A trust is a legal arrangement in which one party (the trustee) holds and manages assets for the benefit of another (the beneficiary), according to the terms you set. Trusts are a powerful estate planning tool that can help you avoid probate, maintain privacy, protect assets for minor children, and exercise control over distributions long after your passing.

Unlike a will, a trust typically does not go through probate court, which means your estate can be distributed faster, more privately, and with less expense.

Types of Trusts We Draft

Revocable Living Trust

Created during your lifetime and fully revocable or amendable at any time. Upon your death, assets pass directly to beneficiaries without probate. You typically serve as your own trustee during your lifetime, retaining full control of the assets.

Irrevocable Trust

Once created, generally cannot be modified without court approval or beneficiary consent. In exchange for giving up control, irrevocable trusts may offer asset protection benefits and, in some cases, tax advantages.

Testamentary Trust

Created within a will and takes effect upon death. Commonly used to manage assets for minor children or other beneficiaries who may not be ready to receive a lump-sum inheritance. Goes through probate, but then operates outside of it.

Special Needs Trust

Designed to provide for a beneficiary with a disability without disqualifying them from government benefits such as Medicaid or SSI. Requires careful drafting to comply with applicable laws.
