Texas Probate Options

Independent Administration

The most common form of Texas probate. An independent executor administers the estate with minimal court supervision, making the process faster and less expensive than dependent administration.

Muniment of Title

A streamlined Texas procedure available when the deceased had a valid will and the only asset requiring transfer is real property. It avoids full probate administration and is significantly faster.

Small Estate Affidavit

When the total value of the estate (excluding homestead and exempt property) is $75,000 or less, heirs may be able to use a small estate affidavit to collect assets without a formal probate proceeding.

Intestate Succession
